1. Agreement and eligibility
These Terms form a binding agreement between you and Black Label Real Estate for the services described here. By creating an account, starting a subscription, using an issued API credential, downloading the software or otherwise using the service, you accept these Terms and the Privacy Policy. If you use the service for a company, you represent that you can bind that company.
You must be at least 18 and able to form a contract. The service is offered for lawful real-estate research and business use in the United States.
2. The service
Black Label Real Estate is desktop software and a hosted data service for sourcing and analyzing real-estate opportunities. Features can include parcel search, public-record owner and address fields, map views, teardown and absentee signals, user-supplied probate text parsing, comps, deal calculations, routes, exports, accounts, optional workspace sync and support.
Coverage, sources, record count, freshness and fields differ by county and may change. Archived records are not necessarily live-searchable. A source can go offline, change terms or publish an error. We may add, modify or remove a feature or source, but we will not silently replace missing facts with fabricated data.
3. Accounts, credentials and security
You are responsible for accurate account information, your devices, passcode, emailed sign-in codes, API tokens and provider keys, and all activity under them. Do not share a subscriber token or bypass rate, row, feature or account limits. Notify us promptly through Contact if a credential or account may be compromised.
We may require reasonable verification for account, billing, security or public-record removal requests. You must not submit another person's information or request removal of another person's record without authority.
4. Subscription, automatic renewal, cancellation and refunds
Current direct plan: $99.00 per month. The subscription renews automatically each month until canceled.
You authorize Stripe to charge the payment method provided at checkout for recurring fees and applicable taxes. Cancel before the next renewal through your account. If the billing portal is unavailable, email michael@blbestate.com from the purchase address; a valid cancellation request received before renewal stops the next charge. Deleting a site account does not by itself cancel Stripe billing.
Cancellation stops future renewal and access generally continues through the paid period. Eligible payments have a seven-calendar-day refund window described in the Refund and Cancellation Policy. Nothing in these Terms limits non-waivable cancellation, refund or automatic-renewal rights.
5. Property data, derived signals and removal
Owner names, situs and mailing addresses, coordinates, parcel identifiers, values, sale details and other source fields come from government public records. These fields can be personal information even though the source is public. We do not promise that a source record is correct, complete, current, unique or suitable for your purpose.
Absentee, estate-owner, teardown, value-spread, ARV, comp and opportunity outputs are research signals or estimates based on available inputs. They are not appraisals, consumer reports, legal opinions, title reports, investment advice, brokerage services or promises of a transaction or profit. Verify every material fact with the source and qualified professionals before acting.
Records may be corrected, suppressed, archived or removed without notice. If we notify you that a previously exported record was suppressed, you must stop using it and delete it from active lists and downstream systems you control. Any person can use the public record-removal channel; an account is not required.
6. Acceptable use
You may use the service for lawful real-estate acquisition, disposition, market and property research within your plan. You may not:
- Use the service or its output for tenant, credit, employment, insurance, government-benefit or other eligibility screening governed by the Fair Credit Reporting Act or similar law.
- Harass, stalk, threaten, dox, discriminate against, defraud, surveil or harm a person; violate a protective order; or locate a person for an unlawful purpose.
- Send unlawful, deceptive or unwanted communications. You are responsible for TCPA, CAN-SPAM, Do-Not-Call, state privacy, solicitation and professional-licensing requirements that apply to your outreach.
- Resell, sublicense, mirror, scrape or bulk-extract the API or corpus; build a competing data product; share credentials; evade caps; or access a non-public route without authorization.
- Probe, disrupt or compromise the service; upload malware; misuse a removal channel; misrepresent a source; or strip source and suppression information from exported data.
- Upload protected health information, Social Security numbers, payment-card data, account passwords or other unnecessary sensitive material to workspace sync or support.
Violation can result in immediate suspension or termination and, where appropriate, preservation or disclosure of records required by law.
7. Your content, provider accounts and optional sync
You retain ownership of leads, notes, settings, documents and other content you lawfully provide. You give us the limited permission needed to process content when you ask us to provide a feature, support response or optional sync. You represent that you have the necessary rights and lawful basis for that content.
The desktop workspace is local-first. Parcel requests reach the hosted API. Authenticated workspace sync sends selected named blobs to our hosted service; Base64 encoding is not encryption by itself. Third-party enrichment, mail, maps or other providers used with your own key are governed by your agreement with that provider, and you are responsible for their use and charges.
8. Intellectual property and feedback
We and our licensors own the software, site design, documentation, compilations, source selection, code and branding, excluding underlying public facts and your content. Subject to these Terms and an active entitlement, we grant you a limited, non-exclusive, non-transferable, revocable right to use the service for your internal business purposes.
If you send feedback, you allow us to use it without restriction or payment, provided we do not identify you publicly without permission.
9. Disclaimers and limitation of liability
The service is provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted operation and data accuracy. We do not warrant a lead, valuation, source, route, mailing, integration, deal or business outcome.
To the fullest extent allowed by law, Black Label Real Estate and its operators, suppliers and affiliates will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, lost profit, lost opportunity, lost data or the conduct of a property owner, recipient, source or provider. Our aggregate liability arising from the service will not exceed the amount you paid for the service during the 12 months before the event giving rise to the claim. These limits do not apply where law does not permit them.
You are responsible for your due diligence, communications, offers, contracts, licensing, data use and compliance. You agree to indemnify and defend us from third-party claims arising from your unlawful use, outreach, exported data, provider activity, content or violation of these Terms, to the extent permitted by law.
10. Suspension and termination
You may stop using the service and cancel renewal at any time. We may suspend or terminate access for nonpayment, security risk, unlawful use, material breach, source restrictions or legal requirements. Where practical and safe, we will give notice and an opportunity to cure.
On termination, your license and hosted access end. Terms that by their nature should survive—including ownership, payment obligations, prohibited use, disclaimers, liability limits, indemnity, suppression duties and dispute terms—continue to apply.
11. General terms and contact
These Terms, the Privacy Policy, the Refund and Cancellation Policy, and checkout disclosures are the entire agreement for the service. If a provision is unenforceable, the remaining provisions remain in effect. Failure to enforce a term is not a waiver. You may not assign the agreement without our consent; we may assign it with a business transfer.
Alabama law governs these Terms, without regard to conflict-of-law rules. Courts located in Baldwin County, Alabama have exclusive venue, except where applicable law gives you a non-waivable right to another forum. Before filing a claim, contact us and allow 30 days for an informal resolution.
